INTELLECTUAL PROPERTY & DMCA POLICY

At HalaTeeVault, we deeply respect the creative work and intellectual property rights of artists, designers, and creators worldwide. As a dedicated online destination for custom graphic tees, hoodies, and personalized apparel, we strictly forbid the sale or listing of any merchandise that infringes upon third-party intellectual property—including copyrights, trademarks, and registered patents.

In full compliance with the Digital Millennium Copyright Act (DMCA) and applicable international laws, our team is committed to responding swiftly and decisively to legitimate notices of alleged copyright infringement.

A. How to Report Intellectual Property Infringement

If you discover that your original artwork, logo, or intellectual property has been reproduced on HalaTeeVault apparel or products without your explicit authorization, please follow the protocol below. Upon receiving a valid and complete takedown notice, we will immediately:

  • Remove or disable access to the contested design, product listing, or imagery.
  • Alert the user, vendor, or contributor responsible for the listing that the content has been taken down.
  • Permanently terminate access and services for repeat offenders.

To submit an official DMCA takedown request, please provide the following details to our Designated Copyright Agent:

  1. Identify Your Work: A clear description of the copyrighted artwork, trademark, or intellectual property you claim has been infringed (please include registration numbers or links to your original work, if applicable).
  2. Identify the Infringing Material: A description of the specific apparel design or product you believe violates your rights, along with the exact URL(s) where the infringing item can be found on the HalaTeeVault website.
  3. Your Contact Information: Your full legal name, physical mailing address, telephone number, and a valid email address.
  4. Good Faith Statement: A declaration stating: "I have a good faith belief that the use of the copyrighted materials described above is not authorized by the copyright owner, its agent, or the law."
  5. Statement of Perjury: A declaration stating: "I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
  6. Signature: Your physical or electronic signature.

B. How to Submit a Counter-Notice

If you are a creator who believes your graphic tee or product listing was removed (or access was disabled) due to a mistake, misidentification, or because you hold the proper licensing and authorization (e.g., fair use), you have the right to file a counter-notice with our Designated Agent. Your counter-notice must include:

  1. Identify the Removed Material: A description of the design or product that was taken down, including the exact URL where it appeared on HalaTeeVault before removal.
  2. Statement of Perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.
  3. Your Contact Information: Your full name, physical address, telephone number, and email address.
  4. Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Dallas, Texas, if you reside outside the United States), and that you will accept service of process from the individual who filed the original infringement claim.
  5. Signature: Your physical or electronic signature.

*Note: Upon receiving a valid counter-notice, HalaTeeVault will forward a copy to the original complaining party. If the original complainant does not notify us within 10-14 business days that they have filed a court action seeking an order against you, we may restore the removed apparel listing at our sole discretion.

C. Warning Regarding False Claims

Please be advised that under Section 512(f) of the DMCA, any individual who knowingly and materially misrepresents that a product or activity is infringing, or that a product was removed by mistake, may be held legally liable for damages. This includes financial responsibility for legal fees and costs incurred by the alleged infringer, the copyright owner, or HalaTeeVault as a result of relying on your misrepresentation.
